The period of absence for over a decade is far too large for this court to exercise equity jurisdiction under Article 226 of the Constitution of India in favour of the petitioner. If the Inquiry Officer tried to soften the blow by recommending a sympathetic consideration, then his sympathy was misplaced. In any case, the sympathy factor did not weigh in the mind of the Disciplinary Authority when it dismissed the petitioner from service for prolonged absence. It is not possible to believe that illness could be serious enough not to follow procedure or seek sanction of leave or extension of leave by resort to proper means.

No ground for interference is made out.

The petition stands dismissed.
