G.S.SANDHAWALIA, J. (Oral) The petitioner seeks a direction to the respondents for grant of selection/senior scale/proficiency step up after completion of 14 years of service applicable under the Assured Career Progression Scheme applicable vide notification dated 03.11.2006 (Annexure P-5) alongwith consequential benefits. It is the case of the petitioner that respondent no. 3 had recommended to respondent no. 2 for the grant of said benefits on 16.07.2008 and the matter is pending consideration. Counsel submits that a legal notice dated 10.12.2015 (Annexure P-16) has been served upon the respondents but no action has been taken on the same. He further submits that he would be satisfied if a time bound decision is taken on the said legal notice. Notice of motion.

CWP No. 6849 of 2016 opinion that there is no need for the respondents to file reply. Accordingly, without commenting on the merits of the case this writ petition is disposed of with a direction to respondent no. 2 to decide the legal notice dated 10.12.2015 (Annexure P-16) within a period of 3 months from the date of receipt of certified copy of the order. Needless to say if the relief is to be denied, a reasoned order be passed and conveyed to the petitioner.
