***** ARCHANA PURI, J. (Oral) As per the observations made in the order dated 13.05.2025, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte.
The counsel for the applicant heard.
The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/233/2023, titled 'Jaspreet Singh Vs. Sukhjit Kaur', filed by the respondent-husband, pending in the Family Court, Kurukshetra and she seeks transfer of the same to the Court of competent jurisdiction at Yamuna Nagar.
It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 20.01.2019. One son born from the said wedlock, who is about 4 years old, is in the care and custody Sonu 2025.05.19 15:33 I agree to specified portions of this document P&HHC
TA-887-2024 of the applicant. Also, it is submitted that the applicant is not having any source of earning and as such, is dependent upon her parental family. Even, she has filed the petition under Section 125 Cr.P.C. i.e. MNT-66-2024, for seeking maintenance for herself and the minor child and the same is pending in the Courts at Yamuna Nagar. Also, the applicant has got lodged an FIR bearing No.123 dated 31.05.2024, under Sections 323, 406, 498-A and 506 IPC, against the respondent and his family members, at Police Station Jagadhri, District Yamuna Nagar.
In view of the submissions aforesaid, more particularly, considering the fact of the applicant not having any source of earning and taking care of the minor child, as well as considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/233/2023, titled 'Jaspreet Singh Vs. Sukhjit Kaur', filed by the respondent-husband, stands transferred from the Family Court, Kurukshetra, to the Court of competent jurisdiction at Yamuna Nagar. The requisite record of the aforesaid case be sent by the Family Court, Kurukshetra, to the District and Sessions Judge, Yamuna Nagar. Learned District and Sessions Judge, Yamuna Nagar, shall assign the said petition to the Family Court, Yamuna Nagar.
