The challenge in the present writ petition is to possession notice dated 08.01.2015 (Annexure P7) served upon the petitioner under Section 13

(12) read with rule 8 of the Security Interest (Enforcement) Rules, 2002. Petitioner has an effective alternative remedy under Section 17 of the SARFAESI Act, 2002. Therefore, present writ petition is disposed of with liberty to the petitioner to avail such other remedies as may be available to him. It will be open to the petitioner to seek condonation of delay, if any, in filing of the application under Section 17 of the Act in accordance with law.
