***** JASJIT SINGH BEDI, J. (Oral) Petitioner seeks the grant of regular bail under Section 439 Cr.P.C. in a case bearing FIR No.92 dated 13.08.2021 under Sections 379-B IPC (Section 411 IPC added later on) registered with Police Station Division No.4, District Ludhiana.

As per the allegations in the FIR, the present petitioner is said to have snatched away the phone of the complainant but the motor cycle slipped and the petitioner fell and was caught at the spot. Learned counsel for the petitioner submits that the petitioner is 19 years of age and is in custody since 13.08.2021.

As per the status report filed by the learned State Counsel, the petitioner has been acquitted in one case, released on probation in another, and is facing trial in the third case.

I have heard the rival contentions of both the parties. Given the fact that the age of the petitioner is 19 years and he is in custody since 13.8.2021, and as many as 11 prosecution witnesses are yet SUKHPREET KAUR 2022.02.28 00:31 I attest to the accuracy and integrity of this document

to be examined, this Court is of the opinion that as the conclusion of trial is likely to consume considerable time, the further detention of the petitioner is not warranted.

Resultantly, without going into the merits of the case, the present petition is allowed and it is ordered that the petitioner-Sunny son of Late Nand Kishore be released on regular bail subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate, Ludhiana.
