Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Surinder Pal in case FIR No. 102 dated 31.05.2019, registered under Section(s) 452, 323, 324, 427, 148, 149 & 120B IPC (Sections 326 & 459 IPC were added lateron) at Police Station Kotwali, Kapurthala, District Kapurthala.

Learned counsel for the petitioner contended that petitioner has been falsely implicated in the case. More so, daughter of the petitioner filed a complaint a day prior to the registration of present FIR and on the basis thereof, FIR No. 101 dated 30.05.2019 was registered under Sections 354, 509 & 511 IPC.

Criminal Misc. No. M-34384 of 2019 Having considered the submissions made by learned counsel for the petitioner and the fact that petitioner-Surinder Pal is the main accused who had caused injuries attracting the provisions of Section 326 IPC and would be required for the purpose of intensive investigation. As such, no case is made out to grant the concession of pre-arrest bail to the petitioner and present petition stands dismissed.
