As regards the nature of the order I proposed to pass, no formal written statement by the State would be necessary at this stage. Petitioners purports to be Ranjit Sagar Dam oustee, and seek a writ in the nature of mandamus so as to direct the respondents to consider his claim and to provide him an employment in terms of Rehabilitation and Resettlement Scheme dated 18.11.1993 (Annexure P5). And, vide representation dated 30.5.2014 (Annexure P-3 Colly) petitioners had even represented to respondent No.4 in this regard. CWP-7808-2015 -2Township, asked the petitioner i.e. Sh. Lalit Singh to appear in the office of Superintending Engineer, Shahpurkandi Dam on 26.11.2014 at 10:30 AM for consideration of his claim.

It is maintained that the petitioner appeared before the Superintending Engineer on the appointed dated at 10:30 AM and submitted requisite documents and prayed that he be afforded an employment in terms of the Rehabilitation and Resettlement Scheme, 2013. But despite that, the claim of the petitoners continues to be pending consideration of the authorities as no formal order in this regard has been passed or intimated to the peteitioners.

Learned counsel for the petitioners submits that let this petition be disposed of only with a direction to respondent No.4 to consider and decide the claim of the petitioners within a specified time. That being so, learned State counsel submits that if the claim of the petitioners is indeed pending consideration of the competent authority, the same shall be considered and decided within a period of two months from today.
