He, therefore, submits that the present appeal may kindly be disposed of as not pressed further with liberty to file a review before the learned Single Judge to point out that the judgment relied upon was not applicable to the facts of the present case along with any other ground permissible in law. 2.

The present appeal stands disposed of as not pressed with the liberty as aforesaid.
