Mr. Navdeep Singh, Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in case FIR No.18 dated 31.01.2024 under Sections 379-B, 34 of the IPC registered at Police Station Division No.8, Jalandhar. 2.
Vide order dated 01.08.2024, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner submits that subsequent to the registration of the FIR in question the parties have effected a compromise with the intervention of the respectable persons. In support, he has drawn the attention of this Court to Annexure P-3 which is the compromise so effected between the parties. It has further been submitted that the FIR in question was registered against unknown persons and the petitioner was not named therein; he came to be nominated as an accused on the basis of a disclosure statement allegedly suffered by the co-accused, who stated that the petitioner was present along with them when they snatched the PUNEET SACHDEVA 2024.09.30 13:57 I attest to the accuracy and integrity of this document Chandigarh

On a pointed query put to the learned counsel as to whether the petitioner is involved in any other criminal case, he has replied in the negative and submitted that although earlier the petitioner was facing trial in a case for an offence under Section 302 of the IPC, however, it is a matter of record that he has since been acquitted in the said case. "

Learned counsel for the petitioner submits that in compliance of order dated 01.08.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.
Learned State counsel, on instructions from ASI Balwinder Kumar, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.
In view of the above, the petition is allowed and interim order dated 01.08.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
