(ORAL) Prayer in present writ petition is for issuance of writ in the nature of mandamus directing respondents to identify post of Taxation Inspector w.e.f. 01.01.1996 and promote the petitioner to the post of Inspector and further Assistant Excise and Taxation Officer with effect from the date posts were available in category of Physically Handicapped person with all consequential benefits.

Learned counsel for the petitioner submits that petitioner, at this stage, would be satisfied if a direction is issued to the 2nd respondentExcise and Taxation Commissioner, Vanijya Bhawan, Plot No.1-3, Sector 5, Panchkula, Haryana to consider the representation dated 10.04.2019 (Annexure P-3) within a stipulated period.

Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct 2nd respondent-Excise and Taxation Commissioner, Vanijya Bhawan, Plot No.1-3, Sector 5, Panchkula, Haryana to consider the representation dated 10.04.2019 PANKAJ KUMAR 2019.09.03 11:36 I attest to the accuracy and integrity of this document

CWP No.22566 of 2019 (O&M) -2- (Annexure P-3) within a period of one month from the date of receipt of certified copy of this order and shall pass a speaking order thereon, failing which respondent No.2 shall be liable to pay costs of `25,000/- to the petitioner. This condition of imposing costs is only to prevent petitioner to run from pillar to post and avail remedy of contempt in case of noncompliance of directions issued by this Court.
