Petitioner is aggrieved by order 22.07.2016, Annexure P-2 passed by Chief Engineer, Irrigation Works, Punjab. His grievance is that Superintendenting Engineer, who is a government official employed in the same department, has been appointed as an arbitrator which is arbitrary. According to him, provisions of 1996 Act have to be taken into consideration. He, thus, submits that matter be remitted to same authority for decision afresh.

Learned State counsel has no objection to this. Under the circumstances, impugned order, Annexure P-2 is hereby set-aside. Matter is remitted to same authority for decision as per law.
