    The defendant assails the correctness of the order passed by the trial Court while dismissing its application under Order 7 Rule 11 CPC to reject the plaint.

Learned counsel representing the petitioner contends that the plaintiff (respondent) after having failed before the Arbitrator appointed under the Punjab Cooperative Societies Act, 1961, is not entitled to maintain the suit.

The plaintiff is a retired employee. He is praying for release of the retiral benefits. Learned trial Court on the basis of prima facie material has found out that the plaint cannot be rejected at the threshold. Keeping in view the aforesaid facts, the revision petition is disposed of with a request to the learned trial Court to decide the suit expeditiously.

All the pending miscellaneous applications, if any, are also disposed of.
