Mr. Mehardeep Singh Dullat, Addl. A. G. Punjab. HARNARESH SINGH GILL, J.(Oral) Case is taken up for hearing through Video Conferencing. The present petition has been filed under Section 482 Cr.P.C. for the issuance of directions to respondent No.2 to conduct a fair and impartial investigation in FIR No.49 dated 23.05.2020, under Sections 457 and 380 IPC, Police Station Rureke Kalan, by transferring it to some senior police officer.
I have heard the learned counsel for the parties. While poring the documents available on record, it is axiomatic that the aforesaid FIR has been got registered by the complainant against respondent No.5 levelling specific allegations against him. Earlier, the petition i.e. CRM-M-30179-2020 filed by the petitioner was withdrawn on 29.09.2020 with liberty to the petitioner to file a fresh one with better PARVEEN KUMAR 2020.12.02 04:08 I attest to the accuracy and integrity of this document
-2CRM-M-40021-2020 particulars. As stated, respondent No.5 had been granted bail by the trial Court. Thereafter, the petitioner moved CRM-M-37010-2020 seeking cancellation of bail granted to respondent No.5, which had been withdrawn on 10.11.2020.
Keeping in view the fact that the above-noted FIR was registered on 23.05.2020 coupled with the fact that respondent No.5, arraigned as accused in the said FIR, has been enlarged on bail by the trial Court and the petition filed by the petitioner seeking cancellation of bail of respondent No.5 stands dismissed as withdrawn, no ground for interference is made out.
Dismissed.
