The present revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 30.07.2019 (Annexure P-1) passed by the Court of learned Additional Civil Judge (Senior Judge), Khamanon whereby the evidence of the plaintiff-petitioner has been closed.

Learned counsel for the defendant-respondent has very fairly submitted that he has no objection if the present revision petition is allowed and order dated 30.07.2019 is set aside. He, however, states that since the matter is pending since long, the same may be made time-bound. Heard.

CR-4964-2019 (O&M) -2In view of the stand taken by learned counsel for the defendantrespondent, the present revision petition is disposed off and the impugned order dated 30.07.2019 is set aside. The plaintiff-petitioner is granted two effective opportunities to lead his evidence at his own risk and responsibility subject to payment of costs of 10,000/- to be paid to the defendantrespondent. It is made clear that no further opportunity would be granted. As the matter is pending since long, I find the prayer made by learned counsel for the defendant-respondent to expedite the matter to be a fair one. The Trial Court is, therefore, requested to expedite the hearing of the matter.

Disposed off accordingly. Pending application, if any, also stand disposed off.
