The instant appeal has been filed impugning the order dated 12.07.2024, passed by the learned Special Court, Fatehgarh Sahib, whereby, the regular bail application of the appellant has been dismissed. 2.

The appellant is alleged to be known to the prosecutrix. The allegations against the appellant are that he had violated the prosecutrix on the pretext of solemnizing marriage with her. The appellant is also alleged to have taken photographs and videos of the prosecutrix. The engagement ceremony of the appellant and the prosecutrix took place on 15.05.2023 and their marriage was fixed for 14.06.2023. However, on 14.06.2023, the appellant did not turn up for solemnization of the marriage. 3.

Learned State counsel has not raised objection with the acceptance of the present petition.

I have heard the learned counsel for the parties and perused the relevant documents.

Both the appellant and the prosecutrix are major. Investigation is complete. Final report/challan under Section 173 Cr.P.C. has already been presented before the trial Court. The prosecutrix has refused for her medical examination, which has been confirmed by the learned State counsel. 7.

In view of the facts and circumstances of this case, the appellant is able to make out a case for grant of regular bail. Consequently, the impugned order dated 12.07.2024, passed by the learned Special Court, Fatehgarh Sahib, declining bail to the appellant, is set aside by accepting the present appeal.

The appellant is ordered to be released on regular bail, subject to his furnishing adequate bonds and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.

However, it is made clear that nothing expressed hereinabove would be construed to be an expression of opinion on merits of the case. 10.

Pending miscellaneous applications, if any, shall stand disposed of.
