The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to appoint her on compassionate ground.

On 16.10.2018 while issuing notice of motion passed the following order:- "Husband of the petitioner, who was working as Chowkidar, died on 31.01.2015. Thereafter, on 07.10.2015, the petitioner moved an application seeking appointment on compassionate ground. Respondents have made a seniority list for the purpose of granting appointment on compassionate grounds. As per letter dated 13.10.2015 (Annexure P-7), her seniority is fixed at serial No.921. Till date, no appointment has been given to the petitioner. However, vide letter/orders dated 18.04.2018 & 09.05.2018 (Annexures P-8 & P-9), allotment of H.No.I/1299-A, Sector 28, Chandigarh, has been cancelled and she has been asked to vacate the said house. The petitioner has not been informed about the fate of her application.

On the next date of hearing, learned counsel for U.T., Chandigarh will inform as to why, even contractual appointment has not been given to the petitioner keeping in view that she has lost her husband."

Learned counsel for the respondent submits that initially petitioner moved an application seeking compassionate appointment, however, later on her daughter moved an application seeking appointment. The application of petitioner's daughter has been processed and forwarded to Apex Committee.

The petition stands disposed of with a direction to respondent to process petitioner's daughter application expeditiously and preferably within six months from today. It is made clear that petitioner would not be liable to vacate house till adjudication of her application, however, she would be bound to vacate house the moment Apex Committee decides her fate.
