Facts of the case are that on 16.06.2024 ASI Jagdeep Singh along with police party was present in the area of bridge canal, village Johlan in connection with checking of vehicles and suspicious persons. Information was received that Sukhdeep Singh, Sandeep Singh and Onkar Singh were indulging in preparing fake Indian currency notes and they were coming in white coloured Verna car No.PB-10JL-9433 from village Qutba towards Johlan and they could be apprehended having possession of fake currency notes and apparatus required for making fake currency. On the basis of this information, naka was organized. From the possession of each of petitioner, one fake currency note in the denomination of Rs.500/- and 115 plain papers of the size of Indian currency notes were recovered from their car. On the basis of this recovery, present petitioners were arrested and booked in the aforesaid FIR.
3.
Learned counsel representing petitioners pointed out that they are falsely implicated in this case. Since the day of arrest, they are behind the bars. Alleged recovery was not effected in the presence of any independent
, witness. Petitioners are already facing trial. Therefore, their regular bail applications may be allowed.
4.
Status report is filed in CRM-37050-2024 titled "Onkar Singh @ Oma Vs. State of Punjab" and it is pointed out that allegations against other petitioners are the same. Therefore, this status report may be read in other two connected bail applications. Learned counsel representing State opposed the bail applications alleging that Onkar Singh @ Oma is involved in several other cases under NDPS Act, Excise Act and various provisions of IPC. However, other two petitioners are not involved in any other case. Challan has been presented in the Court on 14.08.2024. Considering the gravity of offence, petitioners are not entitled to be released on bail. 5.
I have considered the arguments and have gone through the record. Present petitioners were arrested on 16.06.2024 and since then they are behind the bars. Alleged recoveries have been effected and after completion of investigation, even challan has been presented in the Court. Trial of this case may take long time. So far as other FIRs registered against Onkar Singh @ Oma are concerned, those will be decided on its own merits. Considering the facts of the present case and without expressing my mind on the merits, regular bail applications filed by petitioner - Onkar Singh @ Oma [CRM-M-37050-2024], petitionerSukhdeep Singh [CRM-M-38409-2024] and petitioner - Sandeep Singh [CRM-M-39198-2024] are allowed. :A%%(%(>%6 (> 2%
