(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioner in case FIR No.138 dated 02.09.2017 under Sections 376, 120-B, 354 IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 registered at Police Station City Batala, Police District Batala, District Gurdaspur.

Counsel for the petitioner has produced a photocopy of order dated 28.08.2019 passed by Additional Sessions Judge, Gurdaspur, to the effect that the petitioner has surrendered before the trial Court and he has been admitted on bail.

Criminal Misc. No. M-33989 of 2019 -2Considering the fact that the petitioner has surrendered before the trial Court and he has been admitted on bail, the present petition is allowed and the interim order dated 22.08.2019 is made absolute. However, the petitioner shall continue to appear before the trial Court on each and every date of hearing unless his personal appearance is exempted.
