(Oral) The petitioners are Panches of the Gram Panchayat of Village Sher Mohammad Mahigir, Block Guruharsahai, Tehsil Jalalabad, District Fazilka. They allege that some residents of the village including the private-respondents have in collusion with the Sarpanch, encroached upon the Gram Panchayat land comprising streets and ponds and no action is being taken for their eviction. The petitioners have further alleged that fresh constructions are being raised by the unauthorized occupants to whom some residential plots have also been illegally allotted. On this premise, the petitioners seek a direction for eviction of the unauthorized occupants and suitable action against the Sarpanch.

CWP No.7212 of 2016 [2] possibility of political rivalry between the Panches and Sarpanch also cannot be ruled out. Be that as it may, having regard to the allegations of encroachment over the Gram Panchayat land, we dispose of this writ petition with a direction to the Deputy Commissioner, Fazilka and the DDPO, Fazilka to hold a fact finding enquiry and take necessary remedial action against the encroachers, if any, in accordance with law, within a period of four months from the date of receiving a certified copy of this order.

Ordered accordingly.
