(Oral) This is second petition filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the petitioner in case FIR No.0091 dated 29.03.2018 under Section 6 of the Protection of Children from Sexual Offences Act, 2012, Section 506 IPC and Section 3 of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 registered at Police Station Rania, District Sirsa. The earlier petition filed by the petitioner was dismissed as withdrawn vide order dated 07.05.2019.

Criminal Misc. No. M-34141 of 2019 -2Learned senior counsel appearing on behalf of the petitioner has argued that after withdrawal of the earlier petition, on 07.05.2019, sufficient time has elapsed, necessitating filing of the present petition. A perusal of the FIR shows that the victim in the case is a girl of about 6/7 years. On 29.03.2018, the victim had gone outside her home to play and when she did not return, a search was carried out towards Government School, whereupon a noise of weeping was heard from behind the rooms. When the complainant went there, she found that the petitioner was doing wrong acts with her grand daughter. Considering the nature of allegations made against the petitioner and the age of the victim, who was hardly 6/7 years old, this Court finds that the petitioner does not deserve the relief prayed in the case.
