Present petition has been filed for the grant of benefit of interim bail to the petitioner in respect of FIR No.183 dated 31.05.2021 registered under Sections 302, 307 and 34 of IPC (now under Sections 103,109 3(1) of of Bharatiya Nyaya Sanhita 2023 (hereinafter referred to as 'BNS') and Sections 25, 54 and 59 of the Arms Act, 1959 at Police Station Murthal District Sonepat. 2.

A coordinate Bench of this Court vide order dated 03.06.2026 directed the State to file the status report. 3.

In pursuance to the said order, a status report dated 11.06.2026 has been filed by the Assistant Commissioner of Police, Murthal, District Sonepat. The same is taken on record.

Learned State counsel submits that as per the recommendations of the doctor at AIIMS Hospital, New Delhi, the petitioner was sent to the Urology Department, AIIMS Hospital, New Delhi for undergoing the medical procedure but the petitioner refused to undergo the same and he was brought back to the Central Jail No.3, Tihar and further that the general medical condition and vitals of the petitioner are stable as per the medical report of the petitioner. Keeping in view the fact that the petitioner himself refused to undergo the surgery for which, the benefit of interim bail was sought coupled with the fact that today no one appeared on behalf of the petitioner to press the present petition, no ground is made out for the grant of relief as prayed for by the petitioner in the present petition and the present petition is accordingly dismissed.
