Matter has been taken up through video conferencing via Webex facility in the light of the Pandemic Covid-19 situation and as per instructions.
Instant petition has been filed under Section 482 read with Section 407 Cr.P.C. praying for transferring case (registered under FIR No.392, dated 25.12.2009, under Sections 498-A, 406, 506 IPC, at Police Station City Narnaul, District Mahendergarh (now Narnaul)) from Narnaul to any other District Court.
Counsel for the petitioner submits that the FIR in question is pending for adjudication in the Court of District Mahendergarh (now Narnaul). He has argued that the present case is liable to be transferred outside the District Narnaul for the reason that despite number of violations, no action has been taken by the trial Court on the same. CRM-M-46289-2021 -2Sr.No. Date Time Particulars Aug 2009 Firstly, Present petitioner gave complaint against his wife, i.e. Asha Rani 25.12.2009 FIR was registered against the present petitioner 27.12.2009 Police Handcuffed 5-times NBW Non-Bailable warrant issued against the present petitioner and his mother 25.08.2014 Non bailable warrant (hereinafter "NBW") of Manojj's mother was issued first time 18.10.2014 NBW of Manojj mother issued second time.
No proper opportunity was given for defence 18.10.2014 Ld.Judicial Court said bring your mother fitness certificate. As he went to write an application, His NBW were issued.
CCTV Footage were deleted. Fees was charged and single day was given to deposit the Rs.12500/- (approximately) on next day.
18.10.2014 Manojj filed application that my mother was discharged on last date, i.e. 01.10.2014.
27.10.2014 At 11.15 a.m.
NBW of Girni Devi was issued.
At 11.45 am NBW of Manojj was issued Be that as it may, the petitioner if so aggrieved, has the remedy of assailing/challenging the order so aggrieved in accordance with law. However, the contentions raised makes no ground for interference by this Court for transferring the trial from District Mahendergarh now Narnaul to any other District Court.
The Court do not find any merit in the petition and hence, the same is dismissed.
