The writ petition is not maintainable since admittedly the relief sought for is against the Cooperative Sugar Mill which is neither a State nor an instrumentality of State. The issue whether there had been delay caused by the Cooperative Society that results in loss of revenue will be a matter which could be assessed by an appropriate suit for damages, if such a suit is filed before the competent Civil Court. 2.

The writ petition is dismissed.
