Service is waived, as Mr. Rajinder Goyal, learned Additional Advocate General, Punjab accepts notice on behalf of respondents No. 1 to 3. The petitioner was considered to be L-1 in respect of the bids invited by the respondents for the construction/upgradation of roads. Subsequently, the respondents formed an opinion that the petitioner's technical bid itself was non-responsive. The respondents, therefore, by a notice dated 07.01.2016 informed the petitioner and also afforded it an opportunity to furnish a clarification in that regard by 11.01.2016. The petitioner has submitted a detailed response by its letter dated 08.01.2016. The respondents are yet to take a decision on the petitioner's response. The petition is, therefore, premature. 2.

The respondents shall not allot the work to any other party till they take a decision on the petitioner's response.

The petition is, therefore, disposed of as premature. 4.

The petitioner is at liberty to challenge the decision, if it is adverse to it. 5.

Till the decision is taken and for a period of two weeks after the same is served upon the petitioner, the respondents shall not allot the work order to any other party.

In the event of any orders having already been passed in this regard, the same shall be communicated to the petitioner forthwith. (S.J.
