Prayer made in the present petition is for directing the respondents to promote the petitioner to the post of Superintendent Grade-I or on the post of Budgets, Accounts and Audit Fee Recovery Officer. 2.

Learned counsel submits that the petitioner, though is at seniority No.5, however, fulfils the eligibility criteria in terms of the Punjab Cooperative Audit, Group-A, Service Rules, 2007 while the 4 officials senior to him do not, therefore, he is required to be considered for promotion, which has been declined, that too, by passing a non-speaking order dated 26.04.2022, Annexure P-4. He further refers to RTI information to substantiate his claim dated 15.05.2023, Annexure P-8, relating to the same Department wherein the seniors, who were not eligible were left out, while the juniors, who fulfiled the criteria came to be promoted.

The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would not be averse to have a relook at the matter and decided afresh within a period of 4 MOHIT 2025.08.01 12:19 I attest to the accuracy and integrity of this document

CWP-17193-2023 (O&M) -2months, uninfluenced by the order impugned, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. 4.

The aforesaid satisfies the learned counsel for the petitioner. 5.

The matter stands disposed of accordingly and if the petitioner is found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same may be passed after granting opportunity of hearing to him and shall contain reasons, whereupon he shall be free to seek legal redress thereupon.
