* * * * S.J. VAZIFDAR, A.C.J. (ORAL) The petitioner seeks the allotment of an alternate plot as the plot that was allotted in favour of the petitioner is disputed. This in fact was admitted by a communication dated 10.03.2015 from the respondents wherein it was stated that the petitioner could not be given possession of the plot. The letter further states that the recommendation for the petitioner being allotted an alternate plot had been given to the higher authorities and that he had been informed of the same. There is no further communication from the respondents in this regard.

The case of Raghuvir Singh Vs State of Haryana and others, CWP-21822-2013, which was disposed of by an order and judgement of this Court dated 22.11.2013, is similar to the present case. The petitioner therein was allotted plot No. 1015, but possession thereof could not be delivered. CWP-8184-2015 alternate plot with clear vacant possession to the petitioner out of the available plots referred to in that order. The petitioner herein was allotted an adjoining plot in the same process.

In these circumstances, this petition is also disposed of in the same terms as CWP-21822-2013.

It is further ordered that in the event of the plots referred to in CWP-21822-2013 not being available, any other alternate plot shall be allotted to the petitioner in accordance with the policy. 5.
