*** Ritu Bahri, J. (Oral) Petitioners are seeking issuance of direction to the respondents to grant the ACP Scheme as formulated vide policy circular dated 03.11.2016 (P-4) along with all consequential benefits, in view of the law laid down in CWP No. 16446-2010, Jaswinder Singh Bedi and others vs. State of Punjab and others, decided on 20.05.2013 (P-8) in which LPA NO. 244-2014 titled as State of Punjab and others vs. Jaswinder Singh Bedi and others, which stands dismissed on 19.12.2014 (P-9). Further SLP filed by the State stands dismissed and Satbir Singh and others vs. State of Haryana and others , 2002 (2) SCT 354 DB in which it has been held that similarly situated persons should be granted the benefit by the department of its own as well as the law laid down in CWP No. 32849-2019 titled as Jaswinder Singh and others vs. State of Punjab and others, decided on 14.11.2019 (P-18).

In this regard, petitioners had given legal notice dated GAURAV ARORA 2020.12.10 11:44 I attest to the accuracy and integrity of this document Chandigarh 12.09.2020 (P-2) but no action has been taken till date.

On asking of the Court, Ms. Anju Arora, D.A.G. Punjab accepts notice on behalf of respondent-State. Without expressing any opinion on the merits of the case, the present petition stands disposed of by giving direction to respondent No. 1 to pass speaking order on legal notice dated 12.09.2020 (P-2) within a period of four months from the date of receipt of certified copy of this order, in view of judgment (P-18). Further if the petitioners are held entitled to the retiral benefits, the same be released to him within the above period.
