Naresh Kumar Sanghi, J.(Oral) Prayer in this application, filed under Section 151, CPC, is for disposing of FAO No.1308 of 2013 in terms of compromise effected between the appellant/claimants and the insurance company-respondent No.3.
Notice of the application has been accepted by Mr.J.P.Sharma, learned counsel for the appellant, who is present in the Court.
Learned counsel for the non-applicant/appellants states at bar that the appellant/claimants have sorted out their disputes and effected a compromise with the Insurance
[2] company-respondent No.3. As per the compromise, insurance company-respondent No.3 has agreed to pay an additional Rs.2,80,000/- to the appellants. He further states at bar that in view of the said averment in the application moved by the insurance company-respondent No.3, he may be permitted to withdraw the present appeal.
Learned counsel for the applicant/respondent No.3 states at bar that the agreed additional amount of Rs.2,80,000/- (Rupees two lacs and eighty thousand only) shall be paid to the appellants by way of a cheque within three weeks from the date of passing of this order.
In view of the above, the present application is accepted.
FAO-1308-2013 In view of the order of even date passed in Civil Misc. No.6404-CII of 2015, FAO No.1308 of 2013 is pre-poned and taken on today's roster.
Since the appellant/claimants and the insurance company-respondent No.3 have sorted out their disputes and it has been agreed that additional amount of Rs.2,80,000/- (Rupees two lacs and eighty thousand only) would be paid by the Insurance company to the appellant/claimants within three weeks from passing of this order, learned counsel for the
[3] appellants prays for withdrawal of the present appeal. Dismissed as withdrawn.
