H. S. Madaan, J. (Oral) CM No. 24331-CII of 2019 This is an application moved by the Insurance company for disposing of the matter in terms of compromise between the appellants-claimants and respondent No.3-Insurance company. Heard.

FAO No. 1320 of 2013 -2to compromise the matter and pay a sum of Rs.10 lacs over and above the amount of compensation awarded to the claimants by the Tribunal.

Learned counsel appearing for the appellants states that the appellants are ready to compromise in those terms. Accordingly, the appeal is disposed of in terms of the said compromise. It is directed that respondent No.3- Insurance company would pay a sum of Rs.10 lacs to the claimants, which would be over and above the amount of compensation awarded by the Tribunal. As agreed that amount would be paid /deposited in the form of cheque in the name of claimants and as regards minor claimants, in the name of their mother and natural guardian, in the branch of Lok Adalat of this Court, within one month from today and the amount be disbursed /released to the appellants-claimants, in the same manner and in the same ratio, as directed by the Tribunal in the original award. In case this amount is not deposited within one month, the claimants would be entitled to get interest thereon @ 7.5% per annum, till actual payment and they would be entitled to recover this amount by filing an application before the Tribunal.
