Learned counsel for the petitioner submits that the petitioner is entitled for promotion to the post of PGT Hindi as the petitioner fuilfils the requisite eligibility criteria as envisaged under the rule but the benefit of promotion has not been granted to the petitioner whereas the employees junior to him has been extended the said benefit. Learned counsel for the petitioner further submits that keeping in view the facts and circumstances of the present case, the respondents are under an obligation to grant the petitioner the benefit of promotion to the post of PGT Hindi with effect from the date the employees junior to him have been promoted. Learned counsel for the petitioner submits that the grievance which is being raised in the petition, has already been brought to the notice of the respondents vide the legal notice-cum-representation dated 28.04.2022, a copy of which has been attached as Annexure P.7 and the petitioner will be satisfied in case a direction is issued to respondent No.2 to decide the same by passing an appropriate speaking order in a time bound manner.

In view of the pleadings in the present petition, without expressing any opinion on the merits of the case or the claim being made by the petitioner in the legal notice-cum-representation, respondent No.2 is directed to decide the legal notice-cum-representation dated 28.04.2022 (Annexure P.7), by passing a speaking order within a period of eight weeks from the date of receipt of copy of this order. Present writ petition stands disposed of.
