Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Harpreet Singh alias Ajay in case FIR No. 260 dated 19.11.2017, registered under Section(s) 399 & 402 IPC and Sections 25 & 27 of the Arms Act, 1959 at Police Station Jandiala, District Amritsar. Learned counsel for the petitioner contended that petitioner was earlier released on regular bail by the learned Sessions Judge, Amritsar on 02.01.2018 and thereafter, he could not appear in the Court on 29.09.2018 as he met with an accident and his leg was fractured. Thereafter, petitioner was declared as proclaimed offender vide order dated 12.07.2019, passed by the learned trial Court. Except his confinement to the bed because of fracture and medical ground, there was no intention of the petitioner not to appear before the learned trial Court. Learned counsel further contended that petitioner is ready to appear before the learned trial Judge and to furnish fresh bail bonds and surety bonds.

On asking of the Court, Ms. Monika Jalota, Deputy Advocate General, Punjab accepts notice on behalf of the respondent. A copy of paper-book be provided to her during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to regular bail, the learned trial Judge shall admit him to regular bail on his furnishing fresh bail bonds and surety bonds. However, the learned trial Judge shall be at liberty to complete the proceedings against the petitioner under Section 446 Cr.P.C.
