Through the present writ petition, the petitioner seeks the issuance of a writ in the nature of mandamus directing the respondents to count the military service rendered by him towards his total length of service in the Food Corporation of India (hereinafter referred to as the 'Corporation') for the purposes of promotion, seniority and increments. The petitioner was appointed as a watchman in the respondent-Corporation on 26.11.1990 and superannuated on 28.02.2011. The claim to count the military service rendered by him towards his total length of service for the purposes of promotion, seniority and increments was required to be made by him at the time of joining of his services in the respondent-Corporation. After 25 years of unexplained delay and after four years of his superannuation, the present writ petition is hopelessly time barred.
CWP No.8247 of 2015 -2Even otherwise, no provision of law, rule, policy or instruction has been shown which would entitle the petitioner for counting the military service rendered by him towards his total length of service in the respondent-Corporation for the purposes of promotion, seniority and increments.
In view of the above, finding no merit in the present writ petition, the same is ordered to be dismissed. No costs.
