This appeal is instituted against the judgment dated 09.07.2019, rendered by the learned Single Judge in CWP No. 1323 of 2016. 2.

The brief facts necessary for adjudication of the appeal are that the disciplinary proceedings were initiated against the appellant for violation of Rule 21 of the Government Employees (Conduct) Rules, 1966. The appellant had contracted two marriages, one on 07.01.1991 and thereafter with Amarjit Kaur in the year 1994. He was served with notice. He did not file reply to the notice. His services were terminated on 22.06.2000. LPA No. 1646 of 2019 -222.06.2000. The appeal was dismissed on 21.06.2001. He was convicted by the trial court to undergo rigorous imprisonment for ten years with fine of ` 5,000/- under Section 364 IPC. He filed an appeal before this Court bearing CRA-S-978-2003. The judgment of the appellate court was affirmed. The appellant filed SLP before the Hon'ble Supreme Court against the judgment rendered by this Court. The Hon'ble Supreme Court acquitted him on 11.09.2014. He filed a representation on 07.10.2014, after a period of about 13 years. Same was rejected on 17.04.2015.

The acquittal of the appellant in the criminal case has no bearing as far as disciplinary proceedings are concerned. The appellant has admitted the factum of his first marriage with Kuljit Kaur, but his defence was that the marriage was performed under duress from the family of Kuljit Kaur. It cannot be believed. His representation was filed at belated stage. 4.

Accordingly, there is no merit in this appeal and same is dismissed.
