The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 25.06.2025 (Annexure P-3) whereby she has been asked to re-appear in three subjects. 2.
The petitioner claims that as per Schedule, she appeared for examination of three subjects. She successfully cleared the test, however, has been again asked to clear examination of those three subjects. 3.
Mr. Raman Sharma, Addl. A.G., Haryana submits that there is exorbitant increase in the marks of petitioner in comparison to her earlier result, thus, authorities are doubting her marks, accordingly, she has been asked to re-appear for the same subjects.

The respondent has not placed on record any concrete evidence disclosing that there was use of unfair means by the petitioner. In the PARAMJIT KAUR SAINI 2025.07.14 03:42 I attest to the accuracy and integrity of this document
CWP No.17726 of 2025 -2absence of evidence of use of unfair means as well as any particular rule permitting to do so, the respondent could not cancel result of the petitioner and ask her to re-appear for the same subjects. It is relevant to notice here that infrastructure for appearing in the said examination was provided by respondent itself.

In the backdrop, the instant petition stands allowed. The impugned order is hereby set aside. This order would not inhibit the respondent to conduct any independent investigation to find out whether petitioner had used unfair means.
