(ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in case FIR No.043 dated 19.05.2020 registered under Sections 304-B, 34 IPC at Police Station Julkan, District Patiala. Learned counsel for the petitioner inter alia would contend that the petitioner, who is father-in-law of the deceased-Pinki Rani, has falsely been implicated in the instant case. He further argues that wife of the petitioner i.e. mother-in-law of the deceased has already been allowed bail by a Coordinate Bench of this Court vide order dated 15.10.2020 passed in CRM-M No.22387 of 2020 wherein it is noted that the deceased Pinki Rani was staying with her husband in a separate accommodation. The petitioner is in custody since 19.05.2020 and challan has already been presented, therefore, the petitioner is entitled for concession of bail. Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner by contending that no ground PANKAJ KUMAR 2020.12.09 11:22 I attest to the accuracy and integrity of this document

I have heard learned counsel for the parties and have perused the paper book.
Keeping in view the fact that challan has already been presented and the co-accused has been allowed bail by a Coordinate Bench of this Court, no useful purpose would be served by keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
