At the outset, it has been contended by learned counsel for the complainant that the present petition is premature. According to learned counsel for the complainant, in fact, the petitioners are already on bail, and that the present petition for anticipatory bail has been filed merely on the apprehension that due to addition of more sections during the course of investigation the petitioners may be re-arrested. According to learned counsel for the complainant without prior permission of trial Court the investigating agency cannot re-arrest the petitioners, and therefore, at this stage, the present petition is not maintainable.

The learned counsel for the petitioners has submitted that the investigating officer is raiding the house of the petitioners with an intention to arrest them.

In view of above mentioned circumstances, it is hereby ordered that without prior permission of the trial Court the petitioners shall not be MANOJ KUMAR 2026.06.05 09:59 I attest to the accuracy and integrity of this document

CRM-M-32780-2026 (O&M) arrested. The learned trial Court is also directed that as and when the investigating officer files an application seeking for permission to re-arrest the petitioners, notice shall be served upon the petitioners before passing any adverse order.

In view of above, learned counsel for the petitioners wants to withdraw this petition.

Dismissed as withdrawn.
