This is first petition preferred under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No. 42 dated 11.5.2024, under Sections 341, 323, 452, 506, 148, 149 IPC, and later on added Sections 324 and 307 IPC, registered at Police Station Maloud, Khanna, District Ludhiana.

In asking for the relief of pre-arrest bail, learned counsel for the petitioner submits that the role attributed to the present petitioner is that he has given iron Daah blow on the head of Gurjit

Singh, which hit on his left ear, and left side of the head, and subsequently declared to be simple in nature. He further submits that it is a case of version and cross version, as the petitioner's side has also suffered injuries at the hands of complainant side. He further submits that though the petitioner may be a part of unlawful assembly, however, considering his individual role, he may be extended the relief of pre-arrest bail.

This Court has examined the contents of the FIR, which reflects that it is a case, where the petitioner, along with 6/7 persons having deadly weapons in their hands, entered the house of the complainant/victim on the night of 8.5.2024 at 11.30 PM. They then chased one injured Karamjit Singh, who is nephew of the complainant, upto the second house, and then indiscriminately caused injuries to him. The result of the said assault is that Karamjit Singh suffered 9 injuries on his head, and has now become permanently disabled. As per the FIR, the petitioner is one of the assailant who was carrying iron Daah in his hand, entered into the house of the complainant/victim, and also chased one Karamjit Singh, though he caused injuries to one Gurjit Singh, who came to the rescue of Karamjit Singh. In this case four persons have suffered injuries, at the hands of the accused persons, therefore, considering the gravity of the offence, and the specific role attributed

to the present petitioner, this Court is not inclined to grant the extra ordinary relief of pre-arrest bail. Therefore, the instant petition is dismissed.
