...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. D.K. Raheja, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) Prayer made in the present writ petition is for issuance of a writ in the nature of mandamus directing the respondents to regularize the services of the petitioner.

It is the case of the petitioner that he had applied for the post of Data Entry Operator in pursuance of an advertisement issued by respondent no. 7-Punjab Information and Communication Technology Corporation Ltd. on 11.04.2008 and was selected on 12.06.2008 (Annexure P-3). Vide letter dated 20.06.2008 (Annexure P-4), he was deputed to the office of respondent no. 6-Director Public Instructions (Colleges), Punjab. It is his case that since then he is working as Clerk and his work and conduct is good and reliance is placed upon certificate dated 28.11.2014. A representation for regularization was filed on 31.01.2012 to respondent no. 6, on which no action has been taken.

Counsel for the petitioner submits that he would be satisfied if a direction is issued to respondent no. 6 to decide the said representation within a time bound frame.

Accordingly, a direction is issued to respondent no. 6 to take SHIVANI GUPTA 2015.08.18 14:51 I attest to the accuracy and integrity of this document Chandigarh

-2into consideration the said representation and decide the same within a period of 3 months from the date of receipt of certified copy of the order. It is made clear that this Court has not touched on the rights of the petitioner on merits since the appointment letter shows that he was only impanelled by respondent no. 7-Corporation. However, since he has worked since 2008, it is necessary for respondent no. 6 to take a decision, as noticed above. With the above said observations, the writ petition stands disposed of.
