***** SURYA PARTAP SINGH, J. (oral) This petition for pre-arrest bail is the second petition filed by the petitioners under Section 482 of 'the Bharatiya Nagarik Suraksha Sanhita, 2023'. It has been filed with regard to a case arising out of FIR No.125 dated 07.09.2025, for the commission of offence punishable under Sections 115(2), 118(1), 190, 191(3) [Sections 118(2) and 109 added later on] of Bharatiya Nyaya Sanhita, 2023, hereinafter being referred to as 'BNS', Police Station Sekhwan, District Batala. 2.

The petitioner in this case is already on pre-arrest bail, by virtue of order dated 20.01.2026. However, this second petition for pre-arrest bail has been filed in the backdrop of the fact that during the course of investigation, Section 109 of BNS has been added in this case. 3.

In view of the above fact that the petitioner has already joined the investigation and the order, whereby the benefit of interim anticipatory GAURAV THAKUR 2026.06.03 15:12 I attest to the accuracy and integrity of this document

CRM-M-32796-2026 (O&M) bail was accorded to the petitioner, has already been made absolute, it is hereby held that the petitioner is entitled to pre-arrest bail, despite addition of abovementioned Section.

Accordingly, the present petition is hereby allowed and it is hereby observed that in the event of his arrest, the petitioner shall be released on pre-arrest bail on furnishing bonds to the satisfaction of arresting officer. Rest of the terms and conditions of the bail shall be the same. 5.
