HARINDER SINGH SIDHU, J The case is taken up through video conferencing on account of COVID 2019.

This is a petition filed under Section 439 Cr.P.C. for grant of bail in case FIR No. 245, dated 1.8.2020, registered under Sections 379 B, 34 IPC (Section 411 IPC added later on) at Police Station City Kapurthala, District Kapurthala.

FIR was lodged on the statement of Jaspal Singh stating that on 1.8.2020, at about 10.30 am he was going to work by walking. On the way, 3 young men who were on motorcycle snatched his mobile phone. When they attempted to flee away, their motorcycle fell down. They ran away leaving the motorcycle at spot. He identified one of them. Learned counsel for petitioner has argued that petitioner is not named in FIR. He has only been named by one of the accused in his disclosure statement who stated that the petitioner had accompanied him on motorcycle.

The investigation in case is complete and challan has been filed. Petitioner is in custody since 1.8.2020. The trial of case has not made MANOJ KUMAR 2020.12.10 09:18 I attest to the accuracy and integrity of this document

In view thereof, no useful purpose will be served by detaining petitioner behind bars till the conclusion of trial. Accordingly, petition is allowed.
