Present writ petition for re-fixation of the pension after taking the pay scale of Archeological Officer, the post which the petitioner was holding at the time of his retirement in terms of the law settled by this Court in Jagjit Singh and Others v. State of Punjab and Others (CWP-173582015, decided on 09.09.2016). Learned counsel for the petitioner, during the course of arguments, fairly conceded that on the date of retirement of the petitioner i.e. 31.08.2015, he was not getting the pay of Archeological Officer and accordingly, his pension has also not been fixed. However, at the time of arguments, learned counsel contended that at the first stage, petitioner is entitled for pay to the post of Archeological Officer against which he was officiating on the date of his retirement, but he has not been paid the same.
