The writ petition is not competent for a grievance that a Gurdwara is not being properly maintained. The proper remedy shall be only a civil suit under Section 92 CPC seeking for accounting from a religious institution which, according to the petitioner, is not properly run and if it is not properly administered, will have appropriately administered by enabling the Court to frame a scheme on the basis of details furnished and have the persons, who according to the petitioners are mismanaging the trust, to be dislodged and have a fresh body of trustees to be appointed.

The justification for the writ petition is that previously also the petitioner came to this Court complaining that he had made representation to SDM and the Court had directed the SDM to consider the same and pass appropriate orders. This kind of gratuitous observations from the Court allowing for SDM to consider the

CWP No.834 of 2015 -2representation will not give a cause of action for administration of Gurdwara.
