Notice of motion.

[2] On our asking, Mr.Rajesh Bhardwaj, Sr.DAG, Punjab, who is present in Court, accepts notice on behalf of respondent Nos.1 to 5. Let five sets of paper-book be handed over to him during the course of day. [3] In view of the nature of the order, which we propose to pass there is no need to seek any reply-affidavit from the official respondents or to serve respondent No.6 at this stage as no order prejudicial to his interest is being passed.

[4] The petitioner is a candidate for the election of Councillor from Ward No.48 of Municipal Corporation, Amritsar. He alleges that several notorious and anti social elements residing in the area are likely to be Meenu 2017.12.15 15:19 I attest to the accuracy and authenticity of this document chandigarh brought from outside to disrupt the election process scheduled to be held on

CWP-28678-2017 -217.12.2017. A direction is, thus, sought for videography of the polling and counting of votes and to ensure the safety of the petitioner and his family members.

[5] Having heard learned counsel for the parties, though we do not find any material to support the allegations on record, however, having regard to the fact that the authorities are obligated to conduct the election in a fair and free manner, the writ petition is disposed of with a direction to the respondents to videograph the polling and counting of votes of Ward No.48, Municipal Corporation, Amritsar. As regard to the threat, if any, to the life of the petitioner or his family members, Commissioner of Police, Amritsar, is directed to assess the threat perception and take necessary action in accordance with law.

[6] A copy of this order be given Dasti to learned State counsel for information and necessary compliance.
