Mr. H.S. Deol, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail in DDR No.41 dated 14.06.2023 under Sections 323, 324, 34, 326 of the IPC in FIR No.107 dated 09.06.2023 under Sections 323, 341, 148, 149 of IPC registered at Police Station Dasuya, District Hoshiarpur. 2.

While granting the concession of interim anticipatory bail by a co-ordinate Bench of this Court on 01.08.2024, following submissions of learned counsel for the petitioner were recorded:- "Learned counsel for the petitioner inter alia submits that the petitioner has been falsely implicated in the present case. The petitioner has been only attributed an injury with datar, which is simple in nature." 3.

Thereafter, on the previous date of hearing i.e. 27.11.2024, learned State counsel had submitted that the weapon of offence had not been recovered so far. In the circumstances, this Court had directed the petitioner to again join investigation and cooperate with the investigating agency.

Learned State counsel, on instructions, has submitted that there has been compliance of order dated 27.11.2024 and hence, the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 01.08.2024 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
