Let four copies of the the writ petition be supplied to learned State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from respondent Nos.1 to 4 or serve respondent No.5 at this stage as no order on merits prejudicial to its interest is being passed. CWP No.7523 of 2016 [2] The grievance of the petitioners is that against the eviction orders dated 28.11.2014/30.12.2014, they have filed a Statutory Appeal under Section 7(2) of the Punjab Village Common Lands (Regulation) Act, 1961, as applicable to the State of Haryana. While their appeal is still pending, the Block Development and Panchayat Officer, Panipat has issued the impugned notice dated 08.04.2016 (P-4) directing them to hand-over the possession failing which they will be removed with police help.
Having heard learned counsel for the petitioners, we dispose of this writ petition with a direction that let statusquo re: possession or further construction on the sites be maintained till the petitioners' appeal is decided by the Appellate Authority. Further, it would be equally in the interest of justice if the appeal of the petitioners is decided within two weeks from the date of receiving a certified copy of this order.
Ordered accordingly.
