G.S.SANDHAWALIA, J. (Oral) The petitioners seek a direction for finalising the seniority of cadre of ETT with effect from 26.12.2001 in accordance with the provisions of the Punjab State Education Class-III (Primary School Cadre) Service Rules, 1997 and in view of the decision of this Court in Civil Writ Petition No.19832 of 2003-Charan Dass Sharma Vs. State of Punjab and others decided on 9.7.2004 (Annexure P/2).

Counsel for the petitioners submits that the legal notice dated 08.07.2015 (Annexure P/8) has already been issued but no action has been taken on the same and he would be satisfied if a direction is issued to respondent no.3 to decide the said legal notice within some time frame. Notice of motion.

Mr. R.S. Sidhu, Assistant Advocate General, Punjab accepts notice on behalf of respondents. Copy of the writ petition has been supplied to him.

Keeping in view the limited relief sought by the petitioners, this Court is of the opinion that there is no requirement of receiving any reply on SHIVANI GUPTA 2016.01.15 10:46 I attest to the accuracy and integrity of this document Chandigarh

Accordingly, without commenting upon the merits of the case the present writ petition is disposed of with a direction to respondent no.3 to take into consideration the said legal notice dated 08.07.2015 (Annexure P/8) and pass an appropriate order in accordance with law within a period of three months from the date of receipt of a certified copy of this order. In case any adverse order is to be passed then a reasoned order be passed by the said respondent The present writ petition is disposed off with the aforesaid directions.
