Present Public Interest Litigation has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of mandamus directing the respondents to ensure immediate procurement/purchase of sunflower seeds of all farmers through Commission Agents licensed to procure the same at the Minimum Support Price (MSP) fixed by the State of Haryana. Further prayers have been made for directing the respondents No.1 to 5 to take action against
-2the erring Commission Agents who refused to purchase the sunflower seeds at the Minimum Support Price (MSP) fixed by the State of Haryana and also to enhance the time period for purchasing of sunflower crop. 2.
On 03.06.2026, the Co-ordinate Bench of this Court was pleased to pass the following order: - "Present:

**** The instant Public Interest Litigation has been filed under Article 226 of the Constitution of India has been filed by the petitioners seeking a direction to the respondent-State to ensure immediate procurement/purchase of sunflower seeds of all the farmers through Commission Agents, who have been issued licenses to procure the same at the Minimum Support Price (MSP) fixed by the State of Haryana. Learned counsel for the petitioners, while referring to letter dated 26.05.2026 (Annexure P-2) issued by the Directorate, Food, Civil Supplies and Consumer Affairs Department, Haryana, submits that the Dami/Arhatiya commission would be paid @ 1% of MSP (Rs.77.21/- per quintal) during RMS 2026-27. Counsel further submits that the said commission declared by the Government i.e.
1% is not acceptable to the Kacha Aadti Association, Anaj Mandi Shahbad Markanda-respondent No.6 and it has started demanding commission @ 2.5% of MSP. It is, thus, contended that the interests of the farmers are being adversely affected and they are being put to loss, this issue requires to be resolved by the Government.

On the asking of the Court, Mr. P.K. Jhanda, Sr. DAG, Haryana, accepts notice on behalf of the State and seeks time to get necessary instructions.
Remaining respondents be served for 09.06.2026. In the meanwhile, respondents would ensure that necessary steps are taken to amicably resolve of the dispute. June 03, 2026"

Thereafter, replies have been filed on behalf of respondents No.2 and 3 as well as respondent No.6.

Learned counsel appearing for respondent No.1 as well as for respondents No.2 and 3 have stated that as per their latest instructions, Sunflower Seeds which have arrived till 23.06.2026 up to 05.25 PM has been purchased by the Government Agency i.e. HSWC and HAFED and the total lifting of quintals by the said agencies is to the extent of 93505 quintals. It is very fairly submitted on behalf of respondent no.1, 2 and 3 that if the petitioners or any farmers approach respondent No.3 up to 30.06.2026 for selling the Sunflower Seeds, then, the same would also be purchased by the respondent committee/authorities in accordance with the norms.

Learned counsel for the petitioners has submitted that in view of the same, the present petition has been rendered infructuous and the same may be disposed of as such but the respondents No.1 to 3 be bound by the said statement made before this Court. 6.
In view of the same, the present petition is disposed of as having been rendered infructuous.

Respondents No.1 to 3 would be bound by the statement made before this Court.
