The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondent No. 1 to issue his passport.

Learned counsel for the petitioner inter alia contends that petitioner vide application dated 15.06.2023 has applied for passport. Police vide its report dated 16.06.2023 (Annexure P-3) has confirmed that no FIR is pending against the petitioner. FIR No. 117 dated 22.06.2020, under Sections 324, 323, 148, 149 of IPC was registered against the petitioner, however, during the course of investigation, police found him innocent and accordingly G.D. No. 26 was recorded. The police vide its report dated 16.06.2023 has confirmed that petitioner is innocent and he is not involved in the aforesaid FIR. 3.
