The present criminal writ petition has been filed under Article 226 of the Constitution read with Section 482 Cr.P.C., for issuance of directions to respondents No.2 to 5 to protect the life and liberty of the petitioners and not to interfere in their peaceful life at the behest of the private respondents and other relatives.

This Court, on 25.10.2021, while issuing notice of motion, directed respondent No.4-S.H.O., Police Station Lehra, District Sangrur, to take petitioner No.2 to Gandhi Vanita Ashram, Jalandhar. In pursuance thereof, status report dated 16.11.2021, by way of affidavit of the Deputy Superintendent of Police, Sub Division Lehra, District Sangrur, has been filed in the Registry. The same is taken on record.

CRWP-10127-2021 /2/ I have heard the learned counsel for the parties. In the present petition, both the petitioners want to marry with each other. Although petitioner No.1 is major, but has not attained the marriageable age. Since petitioner No.2 is minor i.e. aged about 16 years and 10 months, she cannot be sent alongwith petitioner No.1. A perusal of the status report would show that FIR No.257 dated 16.10.2021, under Sections 363, 366-A and 120-B IPC, Police Station Lehra, stands registered against petitioner No.1 and one Jassi Singh. Even on the basis of statement of petitioner No.2, DDR No.31 dated 10.11.2021, under Section 107/150 Cr.P.C., Police Station Lehra, stands registered against the private respondents, who are father and other relatives of petitioner No.2.

Learned counsel for the petitioner and the learned State counsel submit that they have no objection, if the matter is sent to the Guardian Court, Sangrur, so that efforts can be made to hand over the custody of petitioner No.2 to her near and dear ones for her welfare with her consent.

In view of the above, Registry is directed to send a copy of this case file complete in all respects to the learned District Judge, Sangrur, who will assign the same to the Guardian Court, Sangrur, so that welfare of petitioner No.2-Lovepreet Kaur can be looked into. Disposed of.
