Accordingly, Annexure P-6 and P-7 are taken on record. CWP No. 8462 of 2015 The precise grievance of the petitioner is that he was appointed vide order dated 16.03.1992 as part time sweeper on D.C. Rates (P-6) and his services were regularised w.e.f 26.10.1995 as Peon cum Chowkidar. Now the petitioner is seeking direction to the respondents to take the duties of peon along from him and not to compel him to do the duties of Chowkidar, as stipulated in Haryana State Secondary Education Filed Offices (Group D) Service Rules, 1998. CWP No. 8462 of 2015 -2Reference has been made to judgment passed by this Court (P-3) which was complied by the respondents and respondent No. 2 directed the concerned officers not to take double duty from the petitioners of CWP No. 12756 of 2000. Petitioner is also similar situated employee and thus gave a legal notice dated 15.05.2014 in this regard (P-5) but no action has been taken till date.

Learned counsel for the petitioner states, that at this stage, the petitioner will be satisfied, if directions are issued to respondents to decide the legal notice, referred to above.

In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to the respondent Nos 2 and 3 to decide the legal notice dated 15.05.2014 of the petitioner by passing a speaking order, in accordance with law, within a period of three months from the date of receipt of certified copy of this order.
